The official rules and eligibility
Get your win on, Submit your comic right now!Eligibility: Contest is open to individuals or groups (each, a "Group") comprised of individuals as listed below (collectively, "Entrants"). All Entrants must be residents Canada or U.S. The Contest is void in geographic locations where otherwise prohibited or restricted by applicable law. Contest is subject to all local, provincial, state and national laws and regulations. By entering this Contest, all Entrants agree to comply with and be bound by these official rules (the "Official Rules") and to comply with all national, state, provincial, and local laws and regulations. Entrants may be comprised of the following and will be asked to register as such:
1.Individuals: A natural person who is solely responsible for the creation of the Entered Comic, as defined below. Individual must be a legal resident of an eligible country (Canada & U.S.), who is 13 years of age or older at the time of entry. Entrants under the age of 18 may be asked to provide evidence of parent or legal guardian consent satisfactory to Sponsors. Entrants may be asked to provide documentation for proof of residence.
2.Groups: Group submissions are permitted. Groups must designate one person (a "Group Representative") to represent the Group in entering the Group submission. Any prize awarded to a Group shall be presented to the Group Representative. Groups may be comprised of a maximum of 3 individuals ("Group Members"), including the Group Representative. Group Representative is responsible for identifying all Group Members and will have final authority in dividing prizes amongst the Group (if awarded). For purposes of this Contest, the Group Representative shall be deemed "Entrant" and must have the permission and consent of Group Members to act in this role and confirm the Group's agreement with these Official Rules. During registration, Entrants may be asked to designate size of Group for administrative purposes only. Group Representative must be a legal resident of an eligible country and must be 13 years of age or older at the time of entry. Entrants under the age of 18 may be asked to provide evidence of parent or legal guardian consent satisfactory to Sponsors. Group Representative may be asked to provide documentation for proof of residence. Groups are solely responsible for their own collaboration and cooperation with respect to Contest participation. In no event will Sponsors officiate in any dispute regarding the activities and participation of Group Members.
Each Entrant may submit no more than three Comics comprising a minimum of 24 pages plus cover per comic, whether as an Individual or as Group Representative on behalf of a Group. However, a Group Member who is not a Group Representative may be on an unlimited number of Groups.
Entrants are eligible to enter the Contest in one of the following two categories and will be asked to register as such:
Term: The Contest begins on June 15th, 2010 at 12:01 a.m. Central Standard Time ("CST") and ends on September 15th, 2010 at 11:59 p.m. CST ("Contest Term"). Top 10 Finalists will be announced on or about September 20, 2010. Grand Prize winners will be announced on or about September 23rd, 2010.
How to Enter: Entrants may enter by registering for a free membership at http://thefabler.com/signup and submitting a web version of the comic at http://thefabler.com/comic/upload. Entrants must also submit the following information before September 30, 2010 at 11:59 p.m. CST ("Contest End Date") to the following email address: contest@thefabler.com. No additional registrations or Contest submissions of qualifying Entered Games will be accepted after the Contest End Date.
- Username and Email address in accordance with the corresponding thefabler.com user account that submitted the comic(s).
- If applicable, a group name, corresponding to the group used to submit the comic(s), along with all collaborators involved as stated in Section 1 above.
Additional Entry Requirements: All content of each Entered Comic must be the Entrant's original design and creation. Each Entered Comic must not contain any copyrighted works, including, without limitation, images, characters, logos, or names and trademarks (other than as owned by the Entrant), and must be entirely original, created by the Entrant or be in the public domain. Use of any elements, including, without limitation, images, characters, logos, or names and trademarks (other than as owned by the Entrant), or other materials that are not original or in the public domain may result in disqualification of the Entered Comic, at Fabler Comics Inc.'s sole discretion, unless Entrant has prior written approval from the applicable copyright holders to use such materials. All entry materials must be in English.
Each Entrant grants to Fabler Comics Inc., an irrevocable, royalty free, fully paid, worldwide, nonexclusive license to use (for Fabler Comics Inc. marketing purposes only), review, assess, and otherwise analyze its Entered Comic in connection with the Contest.
Entered Comics must not contain obscene, indecent, hateful, or other offensive or inappropriate content, including, but not limited to, nudity, pornography or profanity. Entered Comics must not contain defamatory or disparaging statements (including, but not limited to, words or symbols that are widely considered offensive to individuals of a certain race, ethnicity, religion, sexual orientation or socioeconomic group) about other people or companies and must not promote use of alcohol, illegal drugs or tobacco. Entered Games must not include threats to any person, place, business, group or nation, invade privacy or other rights of any person, firm or entity, or any other way violate applicable laws and regulations. Fabler Comics Inc., reserve the right to refuse any Entered Comic Submission for any reason at any given point in time in their sole discretion. All such decisions of Fabler Comics Inc., are final.
All Entered Comics will be reviewed for content before being judged; however, such review does not relieve Entrant from responsibility for compliance with these Official Rules. Entered Games that do not comply with these Official Rules or that otherwise contain prohibited or inappropriate content as determined by Fabler Comics Inc., in their sole discretion, will be disqualified and will not be considered for a prize. Fabler Comics Inc., will make the final determination as to which Entered Comics are eligible to take part in this Contest and be considered for a Finalist prize. Certain Comic Submissions and Entrant Comic information and images may be featured from time to time on the Contest Website during the Contest Entry Period, in Fabler Comics Inc.'s sole discretion. Being selected as a featured Comic Submission is unrelated to the Judging Criteria (as defined below) and does not guarantee selection as a Finalist in the Conte
Commercially available Entered Comics must be self-published by the creator and meet all before-mentioned criteria and Group criteria including a Group size not exceeding 3 individuals. Entered Comics available in retail stores or similar distribution channels must not be published as part of a contractual agreement with a major publisher.
Judging: Finalists will be judged according to the criteria ("Judging Criteria") set forth below by a panel of judges, consisting of editors of Fabler Comics Inc., will consider the following overall criteria: (1) originality (uniqueness of concept); (2) story (plot and subplots, narrative, character dialog, etc.); (3) artwork (final style and quality of the line art, coloring); (4) layout (overall panel design, sequential pacing, reader leading, etc.); (5) the number of total thefabler.com votes in each category Story and Style; and (6) average rating in each thefabler.com voting category of Story & Style. Application of the Judging Criteria to Entered Comics as to matters of subjectivity shall be at the judges' sole discretion. The judges' decisions are final and binding in all matters relating to this Contest.
Finalists will be announced on or about September 20, 2010, publically on Fabler Comics blog site, thefabler.com account on or about September 15th, 2010. Finalists will need to provide identification confirmation as instructed, to be awarded any prizes if eligible. If, after several reasonable attempts to determine or contact any Finalist, or the Finalist does not respond within seven calendar days of such notification, the entire prize will be forfeited and Fabler Comics will seek an alternate Finalist from among all remaining eligible entries. A potential Finalist may be required to obtain releases from all members of their respective Group and/or any and all third parties appearing in or implicated by their respective Entered Comic. If any potential winner is considered a minor in his/her jurisdiction of residence, an Affidavit of Eligibility and/or Liability/Publicity must be signed by his/her parent or legal guardian.
Prizes: If an eligible Entered Comic is selected as a Contest Finalist, the following prizes will be awarded and delivered via Mail or International Courier to a confirmed address no later than October 15th, 2010. Contest Finalists need not be present to win prizes. ARV of all prizes combined: $16,000.
As a Third Prize Winner, Total of one (1) Finalist, Each Finalists receives:
- PS3 Prize Pack (Playstation 3 Game Console & Little Big Planet PS3 Game) per person (one per Group Member for a maximum of 3 Group Members).
As a Second Prize Winner, Total of one (1) Finalist, Each Finalists receives:
- Wacom Intuos4 Prize Pack (Wacom Intuos4 - Extra Large Model tablet) per person (one per Group Member for a maximum of 3 Group Members).
As a Grand Prize Winner, Total of one (1) Finalist, Each Finalists receives:
- Wacom Cintiq 21UX Prize Pack (Wacom Cintiq 21UX) per person (one per Group Member for a maximum of 3 Group Members).
Prize Restrictions: Prizes are non-transferable and no substitutions are allowed except by Fabler Comics, who reserves the right to award a prize of equal or greater value should any prize become unavailable for any reason. Taxes, duties or other costs, if any, relating to receipt, acceptance and or use of prizes are the sole responsibility of the prize winner, and Fabler Comics is not responsible for any disputes arising between Group members regarding prize dispersal. If for any reason the Contest is not capable of running as planned due to, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, Fabler Comics, reserves the right, in their sole discretion, to cancel, modify or terminate the Contest. Fabler Comics reserves the right to modify the Official Rules as posted on the Contest Website, and an Entrant shall be deemed to have received notification of such modified Official Rules and accepted such modified Official Rules by virtue of such Entrant's continued participation in the Contest. Should an Entrant not wish to continue to participate in the Contest pursuant to the prevailing Official Rules, as modified or interpreted, an Entrant may terminate participation in the Contest upon notice to Fabler Comics.
Participation in Contest and/or acceptance of a prize constitutes each Entrant's permission for Fabler Comics to use his/her name, address, likeness, photograph, picture, portrait, voice, biographical information, Entered Comic, and/or any statements made by each Entrant regarding the Contest or Sponsors for advertising and promotional purposes without notice or additional compensation, except where prohibited by law.
Privacy: Any information collected will be subject to thefabler.com Privacy Policy, located at http://thefabler.com/legal.jsp (the "Policy"). By entering the Contest, Entrant acknowledges that Entrant has agreed to the Policy and Entrant consents to the collection, use and disclosure of Entrant's personal information for the purposes of administering this Contest in accordance with the Policy. If Entrant wishes to access or correct Entrant's personal information held by us, opt out of receiving further communications from us or our affiliated merchants or companies, or have other questions respecting our privacy policy, please contact us at cm@thefabler.com.
Representations: By entering the Contest, each individual and/or Group Representative submitting entry materials (including an Entered Game) represents and warrants that:
- The Entrant and the Entered Comic fully comply with all eligibility requirements and all other provisions of these Official Rules.
- In preparing the Entered Comic and entering and participating in the Contest, the Entrant has complied and will comply in all respects with all applicable laws, regulations, and rules (including any applicable rules and policies of the Entrant's employer or academic institution if the Entrant is representing their employer or academic institution in the Contest) and has not violated nor will violate any agreement or understanding by which it is bound, including any confidentiality, employment, consulting, intellectual property assignment, or license agreement.
- The Entered Comic consists entirely of Entrant's own original work or of work to which Entrant has all necessary rights (whether by virtue of ownership of such rights or having received the express written consent of the creator to use such work).
- Neither the Entered Comic nor the duplication, use, display, performance, or distribution of the Entered Comic will infringe or misappropriate any intellectual property or other proprietary rights of any person or entity.
Conduct: By participating, Entrants agree to comply with and be bound by these Official Rules. Failure to comply with these Official Rules may result in disqualification from the Contest. Entrants further agree to comply with and be bound by decisions of Fabler Comics, which shall be final and binding in all respects. Fabler Comics reserves the right at their sole discretion to disqualify any individual they find to be (a) tampering or attempting to tamper with the entry process or the operation of the Contest or any Fabler Comics web site, (b) violating these Official Rules, (c) violating the Official Rules of service, conditions of use and/or general rules or guidelines of any Fabler Comics property or service, or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Fabler Comics reserves the right, in their sole discretion, to cancel, terminate, modify, extend or suspend this Contest should (in their sole discretion) virus, bugs, non-authorized human intervention, fraud or other causes beyond their control corrupt or affect the administration, security, fairness or proper conduct of the Contest. In such case, Sponsor may select the Finalists or winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Sponsors.
Release and Limitation of Liability: By entering, Entrants release and hold harmless Sponsors and their respective parents, subsidiaries, affiliates, directors, officers, employees and related entities (collectively, "Releasees") from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses to persons and property that may be sustained in connection with the receipt, ownership, or use of any prize from or arising out of participation in this Contest. Sponsors assume no responsibility or liability for (1) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, (2) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Contest, (3) any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsors on account of technical problems, human error or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participants or any other person's computer relating to or resulting from participation in this Contest or uploading any materials in this Contest, (4) technical or human error which may occur in the processing of entries, or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrants participation in the Contest or receipt or use or misuse of any prize.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
Force Majeure: The failure of the Releasees to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, act of public enemies, actions of governmental authorities outside of the control of the Releasees (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.
Disputes: Except where prohibited or otherwise outlined in these Official Rules, Entrant agrees that (1) any and all disputes, claims and causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate Texas State Court, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest, but in no event attorneys fees, and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsors in connection with the Contest, shall be governed by, and construed in accordance with, the laws of the Province of Alberta, Canada, without giving effect to any choice of law or conflict of law rules (whether of the Province of Alberta, Canada or any other jurisdiction) which would cause the application of the laws of any jurisdiction other than the Province of Alberta, Canada.
